Beta Terms of Use for CanoeApp

Welcome to CanoeApp ("Service"). By accessing or using our web application during the beta period, you agree to be bound by these Beta Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.


1. Description of Service

The Service is a web-based platform https://canoeapp.eu designed to assist canoe clubs, sport federations, and organizations ("Entities") to organize canoe competitions, manage athlete data, and publish results. The Service supports specific disciplines, including Canoe Slalom and Wildwater Canoeing, and is designed to support competitions conducted under International Canoe Federation (ICF) competition rules.

The Service is currently provided in a beta version, which means features may be incomplete, changed, interrupted, or removed.


2. Beta status

The Service is offered in beta as a pre-release product for testing and operational validation.

During the beta period:

  • Functionality may be modified without prior notice.
  • Certain modules may be unavailable or unstable.
  • Performance and availability are not guaranteed.
  • Data structures and system behavior may change.

Use of the Service in beta is at your own risk.


3. Eligibility and Authority

By using the Service, you agree to these Terms in your personal capacity and represent that you have the legal capacity to do so.

If you are assigned the Administrator role for an Entity, you additionally represent and warrant that you are authorized to bind that Entity to these Terms and to act on its behalf within the Service. If you are not authorized, you must not use the Service on behalf of that Entity.

If you are assigned the Coach role for an Entity, you represent and warrant that you are authorized to act on behalf of that Entity within the scope of the Coach role (including managing athlete data and submitting entries). If you are not authorized, you must not use the Service on behalf of that Entity.

If you are assigned the Associate role for an Entity, you represent and warrant that you are authorized to act on behalf of that Entity within the scope of the Associate role, which enables you to be assigned to any Competition Role, with capabilities defined in Section 4.1.1.B. If you are not authorized, you must not use the Service on behalf of that Entity.


4. User Accounts, Roles, and Access

To access restricted features, you must register for an account or obtain authorized temporary access. You agree to provide accurate and complete information and to keep your account information current.

4.1. Registered User Roles

Your access and capabilities within the Service are determined by the specific roles assigned to you. These are categorized into Entity Roles (membership within an organization) and Competition Roles (assignments for a specific competition).

4.1.1. Requesting Entity Membership and Roles

A Registered User may request membership in an Entity, or may be invited by an Entity Administrator. Membership and roles are approved and assigned by Entity Administrators. Once assigned, your use of the Service in that role is subject to the obligations and limitations of that role under these Terms.

A. Entity Roles

These roles define your relationship with an Entity (Club or Federation):

  • Administrator: Full control over Entity data, including editing Entity details, managing users and roles, managing athlete data, and creating competitions. This role includes all Coach and Associate capabilities.
  • Coach: Manages athlete data and submits entries for competitions on behalf of the Entity. This role includes Associate capabilities.
  • Associate: Verified member of the Entity who may be selected to serve in Competition Roles.

B. Competition Roles

These roles are assigned per specific competition by a Competition Manager and apply only to that competition:

  • Competition Manager: Responsible for the competition lifecycle, including adding events, processing entries (including entering athlete data for clubs/entities when entries are submitted outside the platform, e.g., by email), defining gate layouts (for Slalom), generating start lists, managing temporary access for judges, and generating results.
  • Competition Judges: Includes Start Judges, Finish Judges, and Section Judges (for Slalom). These roles are responsible for inputting timing data and judging gate negotiations in compliance with ICF rules.

4.2. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us promptly of any suspected unauthorized use or security breach.

4.3. Third-Party Authentication

We may offer sign-in via third-party identity providers. If you choose this option, you authorize us to use information provided by the identity provider (such as your name and email address) to create or link your account. Your use of the identity provider is governed by its terms and privacy policy, and we are not responsible for the provider’s services or availability.


5. Temporary Device Access

The Service allows temporary, device-based access for specific competition functions (Competition Judges, access to Live Results) without requiring a full user account. This access is strictly limited to the duration of the specific competition, commencing one (1) day prior to the start date and expiring at the end of the last competition day.

5.1. Live Results Access

Access to real-time competition results is limited to a specific number of client devices, as configured by the Competition Manager for each event.

  • Access Method: Users obtain access via a shared registration link provided by the organizer.
  • Device Registration: Upon following the link, the specific device is registered to the competition's live view.
  • Slot Management: The Competition Manager can view the list of registered devices and may deny or delete a device's registration at any time. Revoking a device frees up a slot for a new client device.

5.2. Judge Access (Temporary Officials)

For physical persons acting as officials who are not registered users of the Service:

  • Access Method: Competition Managers distribute a unique registration link for each Competition Role. Upon visiting the link, the user must enter a provided access code to gain temporary access.
  • Device Registration: Competition Judges must register their device using the provided credentials to perform judging duties.
  • Security: If you are accessing the Service via these temporary credentials, you agree not to share your access link or code with unauthorized third parties.
  • Acceptance of Terms: Temporary judges must accept these Terms during device registration.

5.3. Liability for Temporary Access

Because temporary Competition Judges are appointed by the Competition Owning Entity (the Entity that owns the competition) and may have limited access, the Competition Owning Entity assumes full responsibility and liability for:

  • The selection and conduct of these persons.
  • The accuracy and integrity of data entered by these persons (e.g., timing and scoring).
  • Ensuring these persons adhere to the acceptable use policies of this Service.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You agree not to:

  • Input false or misleading data regarding athlete identities, ages, or performance results.
  • Manipulate competition scoring or timing data in violation of applicable sports rules.
  • Use the Service to harvest personal data for purposes unrelated to the sporting competition.
  • Attempt to gain unauthorized access to Entity data or competition management tools.
  • Register multiple devices for Live Results access solely to deny access to other legitimate users ("slot hoarding").
  • Interfere with the security or integrity of the Service.

7. Athlete Data and Competition Management

7.1. Entity Responsibility

Entities (Clubs and Federations) are responsible for the accuracy of athlete data (e.g., Year of Birth, ICF Number) they upload. By submitting entries, Entities confirm they have the necessary rights or consents to process their athletes' data for competition purposes.

Where a Competition Manager enters athlete data on behalf of another Entity based on entries submitted outside the platform (e.g., by email), the organizing Entity confirms it has the authority and legal basis to submit that data.

7.2. Public Nature of Sports Data

You acknowledge that the purpose of this Service is to facilitate public sporting events. If a competition is marked "Public," the Service may publish start lists, live results, and final rankings that include athlete names, club affiliations, country, and national federations on the public internet. Year of birth is not published.


8. Compliance with Sport Rules

The Service provides tools to help apply ICF Competition Rules (e.g., Slalom gate negotiation, Wildwater timing). However, the Service is a tool, not an official. The validity of results, disqualifications, and application of penalties are the sole responsibility of the Competition Owning Entity and the persons assigned to Competition Roles for that competition. We do not guarantee that the software is free from calculation errors, though we strive for accuracy.


9. Availability and Modifications

The Service is provided on an "as is" and "as available" basis. While reasonable efforts are made to ensure availability and accuracy, the Service operator does not guarantee uninterrupted or error-free operation.

The Service operator reserves the right to modify, suspend, or discontinue the Service (or any part thereof) with or without notice.

9.1. Subscriptions (Entities Only)

Subscriptions are available only to Entities. Subscription availability, features, and limits may vary by plan and may be modified by the Service operator from time to time.

A. Trial subscription (Paddler)

An Entity may activate the Paddler plan as a free trial once per Entity. The Paddler trial provides access for sixty (60) days and includes up to three (3) competitions (Canoe Slalom, Wildwater Canoeing, or any supported competition type), with up to six (6) events per competition and up to forty (40) entries per competition.

B. Competition voucher subscription (Race Day)

Race Day is obtained through competition vouchers. Each voucher is valid for one (1) competition owned by the Entity. A Race Day competition includes unlimited events and unlimited entries.

C. Time-based subscription (World Cup)

World Cup is obtained for a selected time period (e.g., monthly, quarterly, or annual). During an active World Cup period, the Entity may create competitions subject to a weekly competition creation limit as displayed in the Service for that Entity. World Cup includes unlimited events and unlimited entries.

D. Expiration and subscription changes

Subscriptions do not renew automatically. When a subscription expires, the Entity will not be able to create new competitions, but may continue to use the Service features available to Entities without an active subscription (including submitting entries for competitions owned by other Entities).

An Entity may request to change its subscription at any time. The Service operator may, at its discretion, offer substitutions or exchanges between subscription benefits (for example, exchanging unused competition vouchers for a limited period of access under another plan), as communicated outside the Service or within the Service.


10. No warranty during beta

In addition to the availability and modification terms in Section 9, and to the fullest extent permitted by law, during the beta period the Service operator disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Service operator does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • Defects will be corrected within any specific timeframe.
  • Data loss, corruption, or inaccurate outputs will not occur.

11. System Requirements

The Service requires a modern web browser and a stable internet connection. Cookies must be enabled for session management and time synchronization. Performance may be affected by device capability or network quality. For mobile use, access to external power (e.g., power banks) may be necessary for longer sessions.


12. Suspension, termination, and beta end

Users may stop using the Service at any time.

The Service operator may suspend or terminate user accounts or temporary access that violates these Terms or applicable laws.

The Service operator may also suspend or terminate access to the beta Service at any time, with or without notice, including for security, legal, or operational reasons, and may end the beta phase or transition to a production service version under updated legal terms.

Upon suspension, termination, or end of the beta phase, access to some or all beta data, features, and environments may be limited or discontinued. The Service operator does not guarantee migration of beta data, settings, or outputs to any production version of the Service unless explicitly stated in writing.

Unless otherwise required by applicable law, the Service operator may delete beta data after suspension, termination, or end of the beta phase.

Users are responsible for exporting or retaining any beta outputs they require before the end of beta access.


13. Intellectual Property

All intellectual property rights related to the Service, including software, design, and documentation, remain the property of the Service operator or its licensors. Competition data and results remain under the control of the organizing Entities, subject to these Terms.


14. Privacy and Cookies

Use of the Service is subject to the Privacy Policy and Cookie Policy, which form an integral part of these Terms.


15. Limitation of Liability

To the fullest extent permitted by law, CanoeApp.eu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or goodwill, arising from or related to the use or inability to use the Service.

If liability cannot be fully excluded under applicable law, the total aggregate liability of CanoeApp.eu for all claims arising out of or relating to these Terms shall not exceed EUR 100 (one hundred euros), to the extent permitted by applicable law.


16. Feedback

If you provide feedback, bug reports, or improvement suggestions regarding the beta Service, you grant the Service operator a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable right to use, reproduce, modify, adapt, and incorporate that feedback without restriction and without compensation.


17. Changes to these Terms

These Terms may be updated from time to time. Updates become effective upon publication unless stated otherwise.

Your continued use of the Service after updates are published constitutes acceptance of the revised Terms.


18. Governing Law

These Terms shall be governed by the laws of Croatia, without regard to its conflict of law provisions.
